That seems to be a rather one soded story. The school can't speak much because of child privacy laws. However, if it was multiple times after he knew it was unwanted, it would be harassment. Sounds like bullying going on, too. All that muddies the water, and again, one sided story.
PS That kid is no angel.

Just so you know MF, 9 year-olds have been charged with sex crimes.
