I know that some states have laws that say if you refuse a field sobriety test, you will be arrested and charged with DUI. I've never been completely clear how that's constitutional. In other states they charge you with "refusing to submit to... with reasonable cause..." which is a little bit easier to validate but in those cases by the time the ink dries in front of the magistrate it turns into proxy DUI.
This cop should have watched ol' MFloyd's videos on DO NOT TALK TO THE POLICE. The chit chat was more suspicious than his driving.
