From every indication I can see good ole Bowe was batshit crazy. Perhaps his CO should also be court-marshalled for not discharging his ass and sending him home before he decided to go on walkabout. Best punishment for Bowe would be to just discharge him and say he's a moron - strip him of his benefits and let him go back to Idaho - probably worse than a prison  |

I don't think they do consider insanity as a defense, but just listening to 5 minutes of that Serial podcast convinced me that he was a total loon.
I realize there's a fierce desire to "teach him a lesson" and see him punished, but I think putting him in jail will just increase his martyr complex that he has going on.
Say he deserted, tell him his 5 years in a Taliban prison is enough time served and let him fade into obscurity

I think it is more to reinforce to others the seriousness of desertion during war.
That's why they need to shoot him.

Insanity defenses usually don't play well at a court martial. If that is the defense's plan he will have to be evaluated by a psych panel (I think they call it a "sanity board"). However, in Bergdahls favor, no one understands the military better than the military.
I got a summons to testify at a court martial for a Coast Guard Chief who had 16 years in. He had an "alcohol related incident". He had two previous "incidents" and had been through the dry out once. In the second "incident" he threw a man through a plate glass window. In his current "incident" he got 86'd from the CPO Club for bad behavior. He got into a fight with the JOD, the OD, the Barracks Master At Arms, and some FBI agents who were staying in the barracks. He was taken by ambulance to the hospital at Ft. Eustis to have his head sewn up from the fight. He was a pretty big dude.....about 6'7'' and well over 250 pounds. At the ER someone made the mistake of letting him out of the restraints to go to the bathroom. He trashed the ER. He was given an administrative discharge meaning he had become way more trouble than he was worth. He received no jail time, no fine, no reduction in rank. After numerous appeals he was allowed to finish his 20 and retire. From what I gathered he was a great guy and very professional in his job..........until he drank. My personal opinion was that he was a loose cannon and too dangerous to keep around.
The President has done his job in "leaving no soldier behind". Time to let the military do their job.
